Significant new Employment Act changes are coming! Recently Bill 27 the WORKING FOR WORKERS ACT carried at first reading. The Act allows employees some interesting assistance:
1) "Ban Non-Compete Agreements": Employers can no longer require employees sign non-competition agreements. It seems this is to assist with economic recovery and job creation, allowing more people to start a competitive business after leaving their employment. However, the employee will still be prohibited from competing with the employer's business during employment; and the employer will be able to protect their confidential information, intellectual property and client relationships through the use of narrower clauses, including non-solicitation clauses prohibiting the solicitation of employees and customers.
2) A new "Disconnect From Work" Policy that some call the Right to Logout will require employers with 25+ employees to have a policy in place that relates to the practice of not engaging in work-related communication such as telephone calls or emails, past a certain hour of the day,
3) Temp Agencies will be required to be Licensed: Temporary help agencies and recruiters will be prohibited from acting as such without first procuring a license from the Director of Employment Standards.
