Know the July 1st two changes to the Ontario Highway Traffic Act.
Motorists charged with stunt driving now face harsher penalties.
1. Instead of the previous 7 days, now it is 14 days, double the time, that a vehicle will be impounded; and
2. There is a lower speed threshold for street racing offenders on municipal roads with speed limits less than 80km/h. Now drivers speeding more than 40 km/h over the limit face racing/stunt driving charges.
If found guilty, fines are minimum $2,000 and maximum $10,000. A conviction could also come with a jail term of 6 months.
On 1st conviction, a driver's licence is suspended for minimum 1 year, maximum 3 years.
2nd conviction licence suspension is minimum 3 years, maximum 10 years.
3rd conviction the licence is suspended indefinitely.
These changes form part of the Moving Ontarians More Safely (MOMS) Act, and are in relation to racing/stunt driving contrary to section 172(1) of the Ontario Highway Traffic Act.
